Agreement to Terms

By accessing or using the services provided by Clearpath Portsmouth Tree Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, customers, and others who access or use our tree service offerings.

Services Provided

Clearpath Portsmouth Tree Service provides professional tree care services including but not limited to tree removal, tree trimming and pruning, stump grinding and removal, emergency tree services, land and lot clearing, tree health and maintenance, arborist consulting, and shrub and hedge trimming. All services are performed by trained professionals following industry safety standards and best practices.

Estimates and Pricing

We provide free estimates for our services. All estimates are valid for 30 days from the date of issue unless otherwise specified. Final pricing may vary from the estimate if site conditions, tree conditions, or project scope changes significantly from what was assessed during the initial evaluation. We will notify you of any significant price changes before proceeding with the work.

Payment Terms

Payment is due upon completion of services unless otherwise agreed upon in writing. We accept cash, check, and major credit cards. For large projects, we may require a deposit before starting work. If payment is not received within 30 days of invoice date, we reserve the right to charge interest on the outstanding balance and pursue collection through appropriate legal channels.

Scheduling and Cancellation

We will make every effort to complete work on the scheduled date. However, weather conditions, equipment issues, or unforeseen circumstances may require rescheduling. If you need to cancel or reschedule your appointment, please provide at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee.

Property Access and Responsibility

You agree to provide clear access to the work area and notify us of any underground utilities, sprinkler systems, or other hidden obstacles that could affect our work. While we take every precaution to protect your property, you acknowledge that tree work involves inherent risks and some minor damage to surrounding landscaping may occur. We will discuss these risks with you before beginning work and take reasonable steps to minimize any impact.

Permits and Regulations

You are responsible for obtaining any necessary permits or approvals required by local authorities for tree work on your property. We can advise you on permit requirements, but the responsibility for compliance with local regulations rests with the property owner. We reserve the right to refuse service if required permits have not been obtained.

Liability and Insurance

Clearpath Portsmouth Tree Service carries comprehensive liability insurance and workers compensation coverage. We are not responsible for damage to property or utilities that were not properly marked or disclosed prior to beginning work. Our liability is limited to the amount paid for services rendered. We are not liable for consequential or incidental damages arising from our services.

Emergency Services

Emergency tree services are provided on a best-effort basis depending on crew availability and weather conditions. Emergency service rates may differ from standard pricing due to after-hours work, urgent response requirements, and hazardous conditions. We will provide pricing information before beginning emergency work whenever possible.

Warranty and Guarantees

We stand behind the quality of our work. If you are not satisfied with the services provided, please contact us within 7 days of completion and we will work with you to address any concerns. However, we cannot guarantee the health or survival of trees after trimming or other services, as tree health depends on many factors beyond our control including weather, disease, and ongoing maintenance.

Limitation of Liability

To the fullest extent permitted by law, Clearpath Portsmouth Tree Service shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim arising from our services shall not exceed the amount paid for those services.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
